What is Regulation 4?
Part of the Control of Asbestos Regulations 2012 (CAR 2012), Regulation 4 identifies the "Duty Holder"—usually the owner of the building or the person responsible for its maintenance—and tasks them with protecting anyone using or working in the premises from asbestos exposure.
The 5 Pillars of Compliance
To comply with the law, every Duty Holder must follow these five steps:
The Investigation: You must find out if there is asbestos in the premises, where it is, and what condition it’s in. Important: If a building was built before the year 2000, you must assume it contains asbestos unless you have evidence otherwise.
The Register: You are legally required to keep an up-to-date record (an Asbestos Register) of the location and condition of the materials.
Risk Assessment: You must assess the risk of anyone being exposed to fibers from the materials identified.
The Written Plan: You must create a detailed plan setting out how the risks from these materials will be managed.
Information Sharing: You must provide information on the location and condition of the materials to anyone who is liable to work on or disturb them (e.g., plumbers, electricians, or builders).
Does this apply to me?
The "Duty to Manage" applies to all non-domestic premises. This includes:
Industrial units and warehouses.
Offices, shops, and hospitals.
Common areas of domestic buildings (like hallways or boiler rooms in blocks of flats).
What Happens if I Ignore It?
The HSE (Health and Safety Executive) takes Regulation 4 very seriously. Failure to have a proper asbestos management plan can result in unlimited fines, the closure of your premises, or even imprisonment.
